Scope of This Acceptable Use Policy
This Acceptable Use Policy applies to all use of capture 5,
including the website, pricing pages, checkout pages,
onboarding forms, client communications, managed review
outreach, Human Trust Video placement, customer contact
paths, review platform routing, customer information
handling, account support, reporting, and related business
systems.
This policy applies to clients, prospective clients,
business owners, managers, employees, contractors,
representatives, agencies, partners, authorized users,
billing contacts, and anyone using or attempting to use
capture 5 on behalf of a business.
This policy works together with the Terms of Use, Privacy
Policy, Email Terms, Opt-Out Policy, Cookie Policy,
Disclaimer, Review Platform Disclaimer, Data Processing
Addendum, Campaign Agreement, Billing Policy, checkout
terms, invoices, order forms, and applicable accepted
service documents.
Section 02
Business Use Only
capture 5 is a business-to-business service. The service
may be used only for lawful business, commercial,
professional, or organizational purposes and only by
people authorized to act for the business account
involved.
- The user must be at least 18 years old.

The user must have authority to act for and, when
applicable, bind the business.

Business, billing, contact, and account information must
be accurate.

capture 5 may be used only for lawful business purposes.

Users must not impersonate another person, business,
customer, platform, vendor, employee, or representative.

capture 5 must not be used for fraudulent, deceptive,
abusive, unlawful, personal, family, or household
purposes.
Section 03
Core Acceptable Use Rule
capture 5 is designed to help real businesses send neutral
post-experience review requests to real customers after a
genuine customer experience.
The service may not be used to create fake reviews,
manipulate review ratings, suppress honest customer
feedback, misuse customer information, violate email
requirements, mislead customers, or bypass independent
review platform policies.
Every submitted customer must be connected to a genuine
customer experience with the client business and must
receive a neutral opportunity to provide honest feedback.
Section 04
Prohibited Review Practices
Clients and users may not use capture 5 to engage in
deceptive, unfair, misleading, manipulative, unlawful, or
platform-risky review practices.
- No review gating.
- No sentiment filtering.
- No rating-based routing.

No pre-screening customers before providing a review
opportunity.
- No suppressing unfavorable customer feedback.

No routing only satisfied customers to public review
destinations.

No routing dissatisfied customers away from public
review destinations.
- No pressuring customers to leave positive reviews.

No instructing customers what rating or wording to use.
-
No threats, punishment, retaliation, intimidation, or
hidden penalties connected to customer reviews.

No discouraging honest negative reviews through
deceptive or coercive conduct.
capture 5 may refuse, pause, restrict, suspend, or
terminate service when a client requests review gating,
fabricated reviews, sentiment manipulation, deceptive
routing, review suppression, or another prohibited review
practice.
Section 05
Fake Reviews Are Strictly Prohibited
capture 5 may not be used to create, request, buy, sell,
trade, publish, arrange, encourage, or support fake
reviews, false reviews, fabricated testimonials,
misleading endorsements, or reviews from people who did
not have a genuine customer experience with the business.
- No fake customer reviews.
- No artificially generated fake reviews.

No reviews from people who were never customers.

No employee reviews presented as independent customer
reviews.

No owner, manager, staff, family, friend, vendor,
affiliate, insider, or contractor review that violates
law or platform rules.
- No competitor reviews.

No copied, duplicated, scripted, fabricated, or
mass-produced reviews.
- No review farms or review manipulation groups.

No paid or compensated reviews unless the arrangement is
lawful, properly disclosed where required, and expressly
permitted by the applicable platform.
- No review swaps, trades, or review clubs.
capture 5 may refuse service or stop processing an
account, list, link, instruction, or workflow that appears
connected to false or misleading review activity.
Section 06
Neutral Review Request Requirement
capture 5 requires neutral review request practices. The
customer must remain free to decide whether to respond,
whether to leave a review, which approved destination to
use, what rating to provide, and what content to write.
- Review requests must be truthful and neutral.

Review requests must not promise a benefit in exchange
for a positive review.

Review requests must not request only positive reviews.

Review requests must not discourage negative reviews.

Review requests must not require customers to contact
the business before accessing an approved public review
destination.

Review requests must not imply that capture 5 or the
client controls platform publication.
-
Review outreach may include a direct way to contact the
business when the customer needs help.
Every eligible customer receives a neutral review request
and may receive a direct contact path when help from the
business is needed.
Section 07
Customer Information Rules
capture 5 uses client-provided first-party customer names
and email addresses to provide the managed reputation
service. Customer information may be submitted only when
the client has the right to provide it and authorize
capture 5 to process it for the requested service.

Submit only genuine first-party customers of the client
business.

Submit only customer names and email addresses
reasonably needed for the service.
-
Submit only customers connected to a genuine customer
experience.

Submit only information the client is legally permitted
to provide to capture 5.

Submit only customers the client is permitted to contact
for the applicable review outreach.
-
Do not submit customers whose applicable opt-out,
objection, suppression, or do-not-contact request must
be honored.

Promptly notify capture 5 of relevant opt-outs,
suppression requests, corrections, restrictions,
deletion requests, privacy requests, or complaints.
Section 08
Prohibited Lists and Information Sources
capture 5 is not a cold-outreach tool, prospecting system,
list-rental service, lead-generation blasting system, or
customer-list broker.
- No purchased lists.
- No rented lists.
- No scraped lists.
- No brokered lists.
- No harvested email addresses.
- No cold-prospect lists.
- No competitor customer lists.
- No unrelated lead lists.
- No directory-scraped contacts.

No event lists unless each person had a genuine customer
experience and the client has proper authority to
contact them.

No lists obtained from another business unless the
customer relationship, notices, permissions, lawful
authority, and transfer rights clearly support the use.
capture 5 may reject a list that appears purchased,
scraped, cold, unrelated, unlawful, risky, inaccurate, or
inconsistent with the service model.
Section 09
Prohibited Sensitive Information
capture 5 is designed to process limited customer
identifiers for managed reputation services. Clients must
not submit unnecessary, sensitive, regulated, or high-risk
information unless capture 5 expressly agrees in a signed
written agreement.

No health information, medical details, diagnosis
information, treatment details, patient notes,
appointment details, or protected health information.

No financial account numbers, payment-card numbers,
credit reports, government identifiers, Social Security
numbers, passport numbers, tax identifiers, or insurance
identifiers.
- No information about children.

No passwords, account credentials, security codes,
biometric information, precise location information, or
authentication information.

No unnecessary information concerning race, ethnicity,
religion, political opinions, union membership, genetic
information, sexual orientation, criminal history, or
another legally sensitive category.

No confidential legal, medical, financial, insurance,
employment, education, or government records.
capture 5 may reject, delete, quarantine, suppress,
restrict, or stop processing prohibited information
without automatically waiving valid payment obligations.
Section 10
Email Use Rules
The standard capture 5 customer review service is
email-based. Clients may not use capture 5 email systems,
message workflows, or customer information processing in
a way that violates email, privacy, consumer-protection,
advertising, review, platform, or industry requirements.
- No misleading sender names.
- No false or deceptive subject lines.
- No deceptive message content.
- No unlawful customer contact.
- No bypassing unsubscribe requests.

No resubmitting suppressed customers unless lawful
authority is documented and the prior restriction no
longer applies.

No using capture 5 to contact people who are not genuine
customers.

No unrelated promotions, spam, prospecting, political
messages, fundraising, or unrelated marketing.

No hiding or misrepresenting the client business
identity.
-
No continued review outreach after a valid objection or
opt-out that must be honored.
Standard review outreach uses client-provided first-party
customer names and email addresses and must remain
connected to genuine customer experiences.
Section 11
Review Platform Compliance
Clients are responsible for understanding and following
the rules of each review platform, directory, marketplace,
app store, or public profile selected for use with
capture 5.

Do not use capture 5 to violate Google, Facebook, Yelp,
Better Business Bureau, Trustpilot, or another platform’s
rules.

Do not provide fake, misleading, broken, unauthorized,
or improper review links.
-
Do not claim capture 5 is affiliated with, endorsed by,
approved by, or partnered with a review platform unless
capture 5 provides written confirmation.

Do not claim capture 5 can force a platform to publish,
remove, restore, rank, display, count, or suppress a
review.
-
Do not use review destinations that create deceptive
customer routing or review manipulation.
-
Do not ask capture 5 to access, manage, alter, or
interfere with a platform account unless that service is
expressly accepted in writing.
Independent platforms control their own filtering,
publishing, moderation, ranking, visibility, account
actions, and enforcement decisions.
Section 12
Prohibited Content and Instructions
Clients may not provide, approve, upload, request, or
instruct capture 5 to use content that is unlawful,
deceptive, abusive, defamatory, discriminatory, unsafe,
misleading, infringing, or inconsistent with neutral
review outreach.

No false claims about the business, customers, services,
staff, results, pricing, availability, or credentials.

No misleading claims about review platforms or expected
review outcomes.

No defamatory statements about customers, competitors,
employees, vendors, or platforms.

No discriminatory, hateful, harassing, threatening,
obscene, exploitative, or abusive content.
-
No content that violates intellectual property,
publicity, confidentiality, privacy, or contractual
rights.

No false statements about licenses, certifications,
insurance, professional status, awards, affiliations,
endorsements, or authority.

No content that pressures customers to provide a
particular rating or hide an honest concern.
Section 13
Human Trust Video and Business Materials
Clients that provide a Human Trust Video, logo, business
image, staff name, business detail, review link, customer
service contact path, or other material are responsible
for ensuring those materials are accurate, lawful,
authorized, and appropriate.

The client must have the rights needed to use all
provided materials.

The client must have permission to use names, images,
voices, logos, trademarks, locations, testimonials, and
likenesses included in the materials.

The client must not provide fake, misleading, outdated,
unauthorized, or infringing materials.
-
Business information, contact paths, review links, and
service details must remain accurate.
-
Human Trust Video content must not mislead customers,
pressure reviews, or promise review outcomes.
Section 14
System Abuse and Technical Misuse
Clients and users may not misuse the capture 5 website,
checkout pages, forms, portals, email systems, code,
workflows, vendors, infrastructure, service materials, or
business systems.
- No unauthorized access.

No credential sharing outside authorized business use.

No unauthorized scraping, crawling, copying, or
harvesting of capture 5 content, code, pricing, systems,
or workflows.

No reverse engineering, decompiling, cloning, reselling,
or creating a competing service from capture 5
proprietary materials.

No interference with website, checkout, email, hosting,
payment, form, customer relationship management,
reporting, or vendor systems.
-
No malware, phishing, spam, bots, denial-of-service
activity, or security testing without written
permission.
-
No attempt to bypass payment systems, plan limits,
suppression controls, unsubscribe controls, access
restrictions, or service protections.
-
No unauthorized use of capture 5 branding, legal pages,
designs, templates, messaging, or documents.
Section 15
Billing, Payment, and Chargeback Abuse
Clients and users may not abuse checkout, payment
authorization, recurring payment, invoices, chargebacks,
bank disputes, cancellation requests, or collection
processes.

No submitting a payment method without authority to use
it.
- No false business information during checkout.

No disputing valid authorized charges as unauthorized.

No using a chargeback as a substitute for the
cancellation process.

No blocking payment methods to avoid a valid initial-term
obligation.

No misrepresenting service use, onboarding approval,
customer information issues, or cancellation timing to a
bank or payment processor.

No attempting to avoid payment by changing owners,
managers, staff, payment methods, vendors, business
names, or bank accounts.
Payment abuse, failed payments, chargebacks, and bank
disputes do not automatically cancel the service or erase
valid amounts due under accepted service documents.
Section 16
Responsibility for Employees, Contractors, and Users
The client business is responsible for owners, managers,
employees, contractors, agencies, representatives,
authorized users, billing contacts, and other people
acting on its behalf.

The client is responsible for their instructions to
capture 5.

The client is responsible for their customer information
submissions.

The client is responsible for their review links and
business materials.

The client is responsible for their payment approvals
and billing communications.

The client is responsible for their misuse of capture 5
systems or materials.

The client is responsible for ensuring that authorized
users understand this policy.
Internal disputes among business owners, managers,
employees, contractors, agencies, or payment-card holders
do not automatically waive the client’s obligations to
capture 5.
Section 17
Regulated and Sensitive Industries
Some industries are subject to heightened privacy,
confidentiality, advertising, professional, legal, or
ethical obligations. Businesses in regulated industries
must determine whether their use of capture 5 is lawful
and appropriate.

Healthcare businesses must not submit protected health
information unless a separate signed agreement
expressly permits it.

Legal, financial, insurance, education,
government-related, children’s service, and professional
service businesses must confirm their own industry
obligations.

Businesses must not disclose confidential customer,
patient, client, financial, legal, educational, or
regulated information through capture 5.

capture 5 may refuse or restrict regulated use cases
that create unacceptable legal, privacy, security, or
operational risk.
Section 18
Reporting Suspected Violations
A suspected violation involving a client, user, employee,
contractor, customer list, review request, review link,
business material, payment activity, or account may be
reported to capture 5.
capture 5 may review a report at its discretion. capture 5
is not required to investigate every report, disclose
investigation details, provide continuing updates, take a
specific action, or reach a particular enforcement
decision.
Reports may be sent to

Section 19
Enforcement Rights
capture 5 may act when it believes this policy has been
violated or continued service creates material legal,
privacy, email, platform, payment, security,
deliverability, reputation, customer-experience, vendor,
or business risk.
- Refuse onboarding.
- Reject customer information.
- Suppress customer records.

Remove or reject links, content, instructions, or
materials.
- Pause or delay launch.
- Suspend, restrict, or terminate service.
-
Withhold reports, access, support, or deliverables while
permitted by the applicable agreement.

Require updated approvals, documentation, payment,
account information, or data verification.
-
Report suspected unlawful activity to providers,
payment processors, platforms, authorities, insurers,
or legal advisers where appropriate.

Pursue unpaid balances, indemnification rights,
recoverable costs, damages, or legal remedies.
Enforcement action does not automatically waive valid
payment obligations, unpaid balances, chargeback
balances, or other amounts due under accepted service
documents.
Section 20
No Duty to Monitor Every Use
capture 5 may monitor, review, reject, restrict, or
investigate account activity, customer information,
content, links, payment activity, platform destinations,
and client instructions.
capture 5 is not obligated to monitor every action, list,
message, review destination, client instruction, customer
communication, payment event, or platform outcome.
The client remains responsible for its customer
information, customer relationship, business operations,
customer experience, review platform accounts, staff
conduct, payment obligations, and legal compliance.
Section 21
Client Responsibility for Misuse
To the extent permitted by law and subject to the Terms of
Use, Campaign Agreement, Billing Policy, and accepted
service documents, the client agrees to defend, indemnify,
and hold harmless capture 5 and its owners, officers,
employees, contractors, agents, affiliates, and authorized
providers from applicable third-party claims,
investigations, complaints, losses, damages, penalties,
costs, chargebacks, and reasonable legal fees arising from:

Fake reviews, review manipulation, review gating, or
platform-rule violations.

Missing consent, lawful authority, notice, permission,
or customer-contact rights.

The client’s operations, products, services, personnel,
contractors, customer experience, or customer disputes.

Client-provided materials, links, videos, claims,
offers, or instructions.

Payment abuse, failed payments, chargebacks, or
collection activity.

The client’s violation of privacy, email,
consumer-protection, advertising, review, platform,
tax, industry, or international requirements.

cancellation, chargeback, failed-payment, and collection
matters remain governed by the applicable commercial
documents.

Changes to This Acceptable Use Policy
capture 5 may update this policy to reflect changes in
law, review platform rules, email requirements, privacy
standards, payment rules, security requirements, service
providers, service structure, business operations, or risk
management practices.
Updated terms will be posted with a revised effective
date. Material changes apply prospectively unless
applicable law or an accepted agreement permits different
treatment.
