Scope of This Opt-Out Policy
This Opt-Out Policy applies to unsubscribe requests,
suppression records, email preferences, objections, and
communication restrictions related to capture 5 website
communications, business-to-business marketing email,
client service email, and managed customer review
outreach.
This policy primarily applies to:

Customers whose names and email addresses are supplied
by a client business for authorized review outreach.

Prospective clients, active clients, billing contacts,
authorized users, and other business representatives
who communicate with capture 5.
This policy works together with the Terms of Use,
Privacy Policy, Email Terms, Cookie Policy, Platform
Disclaimer, Data Processing Addendum, checkout terms, and
applicable order documents.
Section 02
Email-Based Review Outreach
The standard capture 5 customer review service is
email-based. It uses limited first-party customer names
and email addresses supplied by the client business after
a real customer experience.
Review outreach may include a thank-you message, Human
Trust Video placement, neutral review request, approved
review destinations, a direct way to contact the
business, unsubscribe functionality, and related
operational information.

Eligible customers receive a neutral opportunity to
provide honest feedback.

Customers may receive a direct way to contact the
business when they need help.

Review outreach may include an unsubscribe link,
reply-based opt-out method, preference option, or
another suppression method.

capture 5 may suppress a customer email address when
required or appropriate.
-
Standard review outreach does not include outbound SMS,
MMS, or automated voice calling.
The opt-out process is intended to respect communication
preferences while preserving the limited records needed
to prevent future unwanted sending.
Section 03
Customer Review Outreach Opt-Outs
A customer who receives a capture 5 review outreach email
on behalf of a client business may use the unsubscribe
method included in the email or another available opt-out
method provided by capture 5.

The opt-out may stop future capture 5 review outreach
for the applicable client business account.

The email address may be recorded in capture 5
suppression systems.
-
The opt-out may be shared with the client business when
needed to honor the request or update client-side
records.
-
The opt-out may not automatically stop communication
sent directly through systems controlled by the client
business.
-
The opt-out does not control email, notifications,
account messages, or settings maintained by an
independent review platform.
A customer may stop capture 5 review outreach without
losing the right to leave an honest review or contact the
business directly.
Section 04
Business Contact Marketing Opt-Outs
Prospective clients, active clients, owners, managers,
employees, billing contacts, authorized users, and other
business representatives may opt out of capture 5
promotional or marketing email where an unsubscribe
method is provided or applicable law requires one.

A marketing opt-out may stop future promotional email
to the specific business contact address.
-
A marketing opt-out does not stop necessary billing,
payment, legal, security, service, account, support, or
operational communications.
-
A marketing opt-out does not cancel a plan, order,
invoice, payment authorization, or agreed service term.
-
Business records may be retained when needed for
billing, accounting, tax, security, fraud prevention,
disputes, collections, or legal compliance.
Section 05
Opting Out Is Not Service Cancellation
An unsubscribe request, preference change, do-not-email
request, objection, or suppression request does not
cancel a capture 5 service plan, accepted checkout,
campaign agreement, order form, payment authorization,
invoice, unpaid balance, or agreed initial service term.

Clients must follow the cancellation process stated in
the Terms of Use and applicable order documents.

Opting out of email does not automatically end valid
payment obligations.

Opting out does not stop recurring billing that remains
contractually due.
-
Opting out does not waive failed-payment balances,
valid chargeback balances, committed initial-term
amounts, lawful collection costs, or other amounts
already owed.

capture 5 may continue necessary legal, billing,
payment, service, security, and account notices where
permitted or required.
Clients seeking to end paid service must use the official
cancellation process. An email opt-out is not a service
cancellation.
Section 06
How to Opt Out
Available opt-out methods may depend on the type of email,
sending system, client account, recipient location, and
service configuration.

Use the unsubscribe link or instructions included in
the email.

Reply with a clear unsubscribe request where
reply-based opt-out is supported.

Contact the client business directly when the request
concerns communication sent through systems outside
capture 5.

Use a preference center or opt-out tool when one is
provided.
A manual request should include the email address to be
suppressed, the business involved, the type of message
received, and enough information for capture 5 to locate
the correct record.
Section 07
Opt-Out Processing Timing
capture 5 uses reasonable efforts to process unsubscribe
and opt-out requests promptly and within applicable legal
requirements.
Processing time may depend on the sending system, request
method, identity matching, client account, service
provider, location, and whether the request was sent to
capture 5 or received first by the client business.

Automated unsubscribe links may process faster than
manual requests.
-
Manual requests may require review, matching,
verification, or coordination with the client.
-
Some email may already be queued, in transit, or being
processed when an opt-out is received.
-
Suppression generally applies to the specific email
address identified in the request.
-
Multiple email addresses may require separate
suppression.
Limited suppression records may remain after an opt-out is
processed so future review outreach can be blocked.
Section 08
Suppression Records
capture 5 may maintain suppression and operational email
records to honor opt-outs, reduce unwanted email,
document compliance, prevent future sending, investigate
complaints, resolve disputes, and protect legal rights.

Records may include the email address, date, request
source, client-account reference, suppression reason,
delivery status, complaint status, and limited
operational notes.

Suppression records may remain after other customer
outreach records are deleted.
-
Limited suppression information may be shared with the
applicable client business when needed to honor the
request.

Suppression records are not sold to advertisers or data
brokers.
-
capture 5 may decline to delete a suppression record
when deletion could cause additional unwanted email or
interfere with a legal obligation.
Section 09
Client Business Responsibilities
The client business remains responsible for its customer
relationship, customer-data source, required notices,
lawful authority, consent records, internal do-not-contact
lists, and opt-out requests received directly by the
business.

Do not submit customers whose applicable opt-out,
objection, or do-not-contact request must be honored.
-
Promptly notify capture 5 of customer opt-outs,
restrictions, exclusions, objections, or privacy
requests that affect review outreach.
-
Maintain internal suppression and do-not-contact
systems.
-
Do not use capture 5 to bypass a customer preference or
valid opt-out.
-
Do not instruct capture 5 to email a customer when the
client lacks the required authority.
-
Update client-owned systems separately when those
systems are not controlled by capture 5.
When a customer opts out directly with the client, the
client must notify capture 5 before that customer is
included in future review outreach.
Section 10
Resubmission of Suppressed Contacts
A client must not knowingly re-upload, re-add,
reintroduce, or resubmit a suppressed, unsubscribed,
excluded, objecting, or do-not-contact customer unless the
client has documented lawful authority and the prior
restriction no longer applies.

capture 5 may automatically reject or suppress a
resubmitted address.

capture 5 may pause or suspend service when repeated
resubmission creates risk.

capture 5 may require confirmation, documentation, or
corrected information before service continues.

capture 5 may reject a list that appears designed to
bypass customer preferences or suppression controls.
Client-side data errors, repeated resubmissions, or
suppression problems do not automatically cancel valid
payment obligations under an accepted agreement.
Section 11
Direct Contact Path and Customer Concerns
Review outreach may include a direct way for customers to
contact the client business when they need help. That
contact path is separate from the unsubscribe process.

A customer concern is not automatically an unsubscribe
request.

An unsubscribe request is not automatically a customer
complaint.

A customer may both opt out and contact the business
about a concern.
-
The client is responsible for addressing customer
concerns that require action by the business.

capture 5 does not guarantee resolution of a concern or
that a customer will leave, change, remove, or avoid a
review.
Section 12
Opt-Out Requests and Privacy Rights Requests
An opt-out generally means a person does not want certain
future email. A privacy rights request may involve access,
correction, deletion, restriction, objection,
portability, or other rights provided by applicable
privacy law.

Opt-outs may be handled through unsubscribe and
suppression systems.
-
Privacy requests may require identity verification,
client coordination, or additional review.
-
For client-provided customer information, the client
business may be responsible for responding to the
request.

capture 5 may forward a request to the client or direct
the requester to the client where appropriate.

Information may be retained when needed for suppression,
billing, legal compliance, security, disputes, fraud
prevention, or another lawful purpose.

Section 13
Service, Billing, Legal, and Security Email
Certain email may be necessary to operate the business,
manage accounts, process payments, provide service,
protect systems, comply with law, and enforce accepted
agreements.
Opting out of promotional email or customer review
outreach does not necessarily stop:
- Billing and invoice notices.
- Failed-payment or payment-method notices.
- Authorized recurring-payment notices.
- Chargeback, dispute, collection, or balance notices.
- Legal or regulatory notices.
- Security and fraud-prevention notices.
- Service and account-administration messages.

Communications needed to complete, maintain, document,
or enforce the business relationship.
Section 14
Third-Party Review Platforms
Opting out of capture 5 email does not control email,
account notices, review requests, moderation messages,
privacy settings, or other communications sent by an
independent review platform.

Google, Facebook, Yelp, Better Business Bureau,
Trustpilot, and other platforms control their own
notification, privacy, and account settings.

capture 5 cannot unsubscribe a person from an
independent platform account or notification system.

capture 5 does not control whether a platform publishes,
filters, displays, ranks, removes, or retains a review.
-
Customers and client businesses should use the
platform’s own settings, privacy tools, help center, or
support process for platform-specific requests.
Section 15
International Opt-Out Handling
Serving businesses across the United States, United
Kingdom, Canada, Australia, New Zealand, Ireland, and
English speaking countries may involve different email,
privacy, unsubscribe, consent, and marketing rules.

capture 5 uses reasonable efforts to honor opt-outs
according to applicable requirements and available
service functionality.

The client remains responsible for the rules that apply
to its customers, industry, location, and customer
relationship.
-
International clients must determine whether their use
of capture 5 is lawful and appropriate in each
jurisdiction.

Local laws may impose different deadlines, consent
requirements, objection rights, identification
requirements, or unsubscribe standards.
-
Mandatory legal rights that cannot be waived remain
subject to applicable law.
Section 16
Verification, Abuse, and False Requests
capture 5 may request reasonable information to locate,
match, or verify the correct record before completing a
manual opt-out, suppression, preference, or privacy
request.
capture 5 may deny, delay, limit, or require additional
verification for a request that appears fraudulent,
abusive, automated, incomplete, unauthorized, malicious,
impossible to verify, or designed to interfere with a
client account, customer relationship, billing record, or
service system.

Additional information may be requested to identify the
correct address or account.

Requests submitted by unauthorized third parties may be
declined.
-
Records may be preserved to investigate fraud, abuse,
security threats, disputes, chargebacks, or legal
claims.

Unsupported or unlawful bulk suppression demands may be
limited or rejected.
Section 17
Suspension and Service Protection
capture 5 may pause, restrict, suspend, or terminate
service when opt-out, suppression, complaint, bounce,
customer-data, or list-quality issues create material
legal, privacy, security, platform, deliverability,
payment, customer-experience, or business risk.

Improper, inaccurate, or unlawful customer information.
-
Repeated submission of suppressed contacts.
-
Failure to notify capture 5 of customer opt-outs.
-
Attempts to bypass unsubscribe or suppression systems.
-
High complaint rates, spam reports, or serious
deliverability problems.
-
Client instructions that conflict with law, platform
rules, or capture 5 policies.
Suspension, refusal, or termination for risk or breach
does not automatically waive unpaid balances, valid
initial-term obligations, failed-payment amounts,
chargeback balances, lawful collection costs, or other
remedies.
Section 18
No Guarantee of Complete or Immediate Blocking
capture 5 uses reasonable processes to honor opt-outs and
suppression requests, but no email system can guarantee
instant or complete blocking in every circumstance.

Email may already be scheduled, queued, in transit, or
processing when the request is received.
-
Different systems and service providers may update at
different times.
-
Multiple email addresses may require separate
suppression.
-
Client-owned systems may require a separate update by
the client.
-
Independent review platforms may maintain separate
email and notification systems.
-
Necessary legal, billing, security, account, service,
or transactional email may still be permitted or
required.
Section 19
Relationship to Other Legal Terms
This Opt-Out Policy works together with the
Terms of Use,
Privacy Policy,
Cookie Policy,
Email Terms,
Disclaimer,
Platform Disclaimer,
Data Processing Addendum
,
checkout terms, and applicable order documents.
If this policy conflicts with a more specific mutually
accepted written agreement, the more specific accepted
agreement controls for that client relationship.
Section 20
Changes to This Opt-Out Policy
capture 5 may update this policy to reflect changes in
law, email systems, service providers, review outreach,
suppression practices, privacy requirements, platform
rules, or business operations.
Updated terms will be posted with a revised effective
date. Material changes apply prospectively unless
applicable law or an accepted agreement permits different
treatment.
