Third-party platforms operate their own websites,
applications, accounts, review systems, moderation
systems, recommendation systems, ranking systems,
publishing rules, content policies, and enforcement
procedures.

control, represent, or speak for an independent review
platform unless a written agreement expressly states
otherwise.

review destinations, profile pages, directories,
marketplaces, app listings, or customer review locations.

according to their own policies, systems, algorithms, and
enforcement decisions.

rankings, local placement, profile visibility, review
snippets, star displays, rating displays, recommendation
status, platform placement, organic traffic, paid
traffic, telephone calls, appointments, bookings, sales,
revenue, or business growth.

Review Links and Approved Destinations

profile links, review-page links, directory links, custom
approved links, business-provided URLs, or other routing
methods available for the selected plan and platform.

responsible for lost reviews, visibility, platform
results, or business outcomes.

legal, privacy, platform, security, reputation,
customer-experience, or compliance risk.

Client Responsibility for Platform Rules
The client is responsible for understanding and complying
with the terms, guidelines, policies, restrictions, and
eligibility rules of each review platform, directory,
marketplace, app store, or profile it chooses to use.

The client is responsible for platform accounts,
profile ownership, listings, account access,
permissions, content, links, and platform compliance.

The client is responsible for determining whether a
platform permits review invitations and what
solicitation practices are prohibited.

The client is responsible for review responses that
require client approval or direction and for ensuring
that client instructions are accurate, professional,
lawful, and platform-compliant.

The client is responsible for penalties, restrictions,
warnings, suspensions, removals, or account actions
caused by the client, its personnel, its other vendors,
its instructions, or its platform history.
capture 5 may refuse a platform destination, response,
link, or instruction that appears to create legal,
ethical, platform, privacy, security, customer-experience,
or business risk.
Section 08
Neutral Review Request Standard
capture 5 supports neutral review outreach following real
customer experiences. Eligible customers receive an
honest opportunity to provide feedback and may receive a
direct way to contact the business when they need help.

capture 5 does not pre-screen customers before providing

Platform Changes and Availability
Independent platforms may change policies, technical
access, review rules, invitation requirements, profile
rules, verification requirements, account access,
publishing systems, moderation systems, rankings, or
display formats at any time.

A platform may require verification or additional

client-approved customer path.
Exact functionality depends on the selected plan, client
authorization, account permissions, country, business
category, platform access, and third-party limitations.

Country and Market Limitations
capture 5 operates from the United States, including New
Jersey.
Serving businesses across the United States, United
Kingdom, Canada, Australia, New Zealand, Ireland, and
English speaking countries does not mean every platform,
feature, connection, or account function is available in
every market.

category, account type, language, and legal environment.

Country coverage means capture 5 may provide service
support in that market.

available in every country.

Clients remain responsible for local privacy,
electronic-message, consumer-protection, advertising,
review, platform, tax, and industry requirements.

Customer Choice and Review Content
Customer reviews are controlled by the customer and the
applicable platform according to platform terms and
applicable law.
capture 5 does not own reviews submitted to independent
platforms and does not control the customer’s rating,
review content, platform selection, timing, editing,
deletion, or decision to leave a review.

When a client believes a review violates a platform’s
rules, the client is responsible for using the platform’s
official reporting, appeal, dispute, moderation, or
support process.
capture 5 may provide limited operational assistance where
available and included, but capture 5 cannot make
platform decisions and does not act as legal counsel,
platform counsel, or a platform representative.
Section 15
Client Responsibility for Platform-Related Claims
To the extent permitted by law and subject to the
applicable Terms of Use, the client agrees to defend,
indemnify, and hold harmless capture 5 and its owners,
officers, employees, contractors, affiliates, agents, and
authorized providers from applicable third-party claims,
losses, investigations, penalties, damages, disputes,
costs, and reasonable legal fees arising from:

Reviews, ratings, review content, public responses, or
customer claims relating to the client business.

Limitation of Responsibility
To the fullest extent permitted by law, capture 5 is not
responsible for independent platform decisions, outages,
restrictions, filtering, review removals, publishing
delays, ranking changes, display changes, moderation,
customer review content, customer sentiment, customer
refusal to review, or business effects caused by an
independent platform.

specific mutually accepted written agreement, the more
specific agreement controls for the applicable client
relationship and subject matter.

Updates to This Disclaimer
capture 5 may update this Review Platform Disclaimer to
reflect changes in platforms, service functionality,
account access, technology, business practices, or legal
requirements.
Updated terms will be posted with a revised effective
date. Material changes apply prospectively unless
applicable law or a mutually accepted agreement permits
different treatment.
A client’s accepted order documents continue to control
the client’s specific pricing, service term, and
plan-specific commitments.
